Who we are and what these terms cover
The ContactZapp service is provided by Silvia Pugi, Via Etna 2, 20144 Milano, Italy, VAT IT08211350965 (“we”, “us”). These terms are an agreement between you and us.
They cover the ContactZapp app at app.contactz.app (the “service”) and our marketing website at contactz.app. By creating an account or using the service, you agree to them. If you don’t agree, please don’t use the service.
They work together with our Privacy Policy and Cookie Policy, which explain how we handle your data.
ContactZapp is built for one person’s own contacts.
The service and your account
What the service does. ContactZapp keeps your contacts consistent across the address books you use: Google, Microsoft, Apple iCloud and any CardDAV address book. It reads the contacts from the accounts you connect, finds duplicates, lets you review and merge them, and writes the result back to your accounts. It also keeps a change history you can roll back, and lets you export your contacts as vCard files or take a full account backup.
Who can use it. You must be at least 18 years old and able to enter into a contract.
Your account. You need an account to use the service. Give us accurate information, keep your sign-in details secret, and tell us promptly if you think someone else has used your account. You are responsible for what happens under your account. One account is for one person.
Connected accounts and your data
What you authorise. When you connect an account, you allow us to read its contacts and, unless you set the account to read-only, to write changes back to it. The service shows you duplicates and proposed merges for review before it writes them back.
Your right to connect. Only connect accounts you are entitled to use. If an account belongs to an employer or another organisation, make sure you are allowed to connect it.
Other providers’ terms. Google, Microsoft, Apple and your CardDAV server are separate services with their own terms, which still apply to you. We are not responsible for their availability, limits or changes.
Your data stays yours. Your contacts remain yours. You give us permission to process them only to provide the service to you, as described in our Privacy Policy. You confirm you may share your contacts’ details with us for that purpose.
Acceptable use
Use the service lawfully and fairly. You must not:
- connect accounts or contacts you have no right to use;
- use the service to send spam, to harass anyone, or to build lists of people’s details for purposes they would not expect;
- try to break, overload or reverse-engineer the service, or get around its limits or security;
- use automated tools to access the service other than through the features we provide;
- share your account or resell access to the service;
- use the service to break the law or someone else’s rights.
If you break these rules, we may suspend or end your account as described in section 7.
Plans, payment and cancellation
Plans. ContactZapp has a free plan and paid plans. Each plan sets limits, such as how many contacts can be synced and how many accounts you can connect. The current plans, limits and prices are shown on our pricing page and at checkout, and the price you see at checkout is the price you pay.
The free plan. You can connect your accounts, run a full sync and see every duplicate we find. The free plan limits how many contacts are changed in your accounts; to go beyond that limit you need a paid plan.
Payment. Payments are processed by Freemius, through its secure checkout. We never see your payment details. Freemius’s terms and privacy policy apply to the purchase. Freemius sells the paid plans to you as merchant of record and handles payment, renewals and refunds. Freemius issues your invoice.
Billing period and renewal. Paid plans run for a month or a year, as you choose at checkout. Freemius charges the payment method you have on file, and the plan renews automatically each month or year, on the anniversary of your purchase, until you cancel. Renewal payments are final and are not refunded, except where the law requires otherwise. For yearly plans, Freemius emails you a reminder about 30 days before renewal.
Taxes. Prices on our website are shown net of taxes. Freemius adds the tax that applies in your country or region at checkout and collects it.
Cancelling. You can cancel a paid plan at any time from the Freemius customer portal (customers.freemius.com), which you can also open from the app. After you cancel, you keep your paid plan until the end of the period you have paid for, and then your account moves to the free plan.
Refunds and your right to withdraw. We offer a no-questions-asked refund window on your first purchase. The period and conditions are shown in the terms at checkout on Freemius, so please read them when you buy. Renewal payments are final, as described above. If you are a consumer in the EU, you may have a legal right to withdraw from a purchase within 14 days. For digital services that start right away at your request, that right can be lost once the service has been fully provided, or reduced in proportion to use. Nothing in these terms limits any right you have by law.
Changes to plans and prices. We may change plans or prices. A change never affects a period you have already paid for, and we will tell you before a price change applies to your next renewal.
Ownership and availability
Our rights. The service, its software, design and the ContactZapp name and logo belong to us. We give you a personal, non-exclusive right to use the service under these terms for as long as your account is open. You may not copy or resell it.
Your feedback. If you send us ideas or suggestions, we may use them without owing you anything.
Availability. We work to keep the service running, but we can’t promise it will always be available or error-free. We may carry out maintenance, and the service depends on providers such as Google, Microsoft and Apple that we don’t control.
Changes to the service. We may improve, change or remove features for valid reasons, such as technical, security or legal changes, or changes made by the providers we connect to. If we make a change that significantly harms how you use a paid plan, we will tell you in advance.
Liability, ending the agreement and changes
What we provide. The service is provided “as is” and “as available”. As far as the law allows, we don’t promise that it will meet every need or that every sync will be error-free. Sync changes what is in your accounts, so please review merges before you approve them and keep your own backup.
Our liability. As far as the law allows, we are not liable for indirect or consequential loss, for loss caused by Google, Microsoft, Apple or another provider, or for loss caused by your breach of these terms. Our total liability to you is limited to the amount you paid us in the 12 months before the event that caused the claim. Nothing in these terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury, fraud, or wilful misconduct or gross negligence, or any right you have as a consumer.
Ending your account. You can stop using the service and close your account at any time. Closing it ends your access; how long we then keep your data is set out in our Privacy Policy.
Suspension and termination by us. We may suspend or end your account if you seriously or repeatedly break these terms, if you misuse the service, or if the law requires it. Where we can, we will tell you why and give you a chance to put things right first. We may also close your account if your use of the service is significantly higher than that of a typical customer and affects how we can run the service for others. In that case we will give you notice and refund the unused part of what you have paid.
Inactive free accounts. If you are on the free plan and have not signed in to the service for more than 3 months, we may delete your account and the data in it. We will email you at the address on your account at least 2 weeks before we do, to tell you the date of deletion. If you sign in before that date, your account stays open. Deletion is permanent. How long backups and other records are kept afterwards is set out in our Privacy Policy. This does not apply to paid plans.
Changes to these terms. We may update these terms when the service or the law changes. We will tell you in the product or by email before a change that matters to you takes effect. We will give you at least 30 days’ notice. If you keep using the service after that, you accept the new terms; if you don’t agree, you can close your account and ask for a refund of the unused part of your plan.
Governing law, disputes and contact
Governing law. These terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
Disputes. Please contact us first so we can try to settle a problem informally. If you are not a consumer, any dispute will be settled by the courts of Milan, Italy. If you are a consumer, disputes are decided by the courts of the place where you live, as the law requires.
If part of these terms is invalid. The rest still applies.
Whole agreement. These terms, with the Privacy Policy and Cookie Policy, are the whole agreement between us about the service.
